Shareholder action to remove CEO at JPMorgan unsuccessful

Shareholders led by Connecticut retirement plans and other pension fund organizations unsuccessfully attempted to have the head of JPMorgan removed.  Less than one-third of the voters actually supported the measure to have the Chief Executive Officer (CEO) stripped of a great deal of his authority.

University Pays $400,000 for Unsecured Electronic Protected Health Information

A recent resolution agreement between the United States Department of Health and Human Services, Office for Civil Rights (HHS) and Idaho State University (ISU) requires payment of $400,000 and implementation of a corrective action program to address the breach of unsecured electronic protected health information (ePHI) of approximately 17,500 patients. According to public information published by HHS (U.S. Department of Health & Human Services), ISU notified federal regulators of a breach and cooperated with an investigation headed by OCR (HHS Office for Civil Rights). "Risk analysis, ongoing risk management, and routine information system reviews are the cornerstones of an effective HIPAA security compliance program," said OCR Director Leon Rodriguez. "Proper security measures and policies help mitigate potential risk to patient information." HHS Press Release

Connecticut was one of the states recently listed as overachieving in the number of business start-ups and entrepreneurships.  The study examined populations and economic output and found there was a disproportionate number of start-up companies that are valued in excess of $100 million.

Federal Judge Makes Short Work of Post-Expungement Defamation Claim

Recently, the New York Times ran an op-ed about the case of Linda Martin against newspapers that had originally published articles about her arrest.  Ultimately, her arrest was expunged under Connecticut law, but the articles have remained in posterity.  She then filed a putative class action alleging that, by failing to delete the account of her arrest, which under law is deemed to have not actually ever occurred due to expungement, continued publication means that true articles are now false and defamatory.
